Terms of service
These terms govern your use of sunny.day. The two that matter most are section 2 — today sunny.day is a discovery and comparison site, not a seller — and section 6 — weather scores are forecasts and are not guarantees of anything.
sunny.day is not open for bookings.
You can browse destinations and compare prices. You cannot complete a booking here today: the site has no checkout, takes no payments and makes no reservations, so no ticket is issued, no hotel room is held and no card is charged. Hotel and flight prices are shown for comparison only. They come from third-party supplier data and can be stale or wrong by the time you look elsewhere.
There is no payment processor connected to this site, and sunny.day is not yet operating as a travel seller. Do not rely on this site to hold a reservation until this notice is removed.
This notice will be removed when those conditions are met. There is no announced date.
1. Who you are contracting with
sunny.day ("we", "us") is a trading name of The Digital Carpenter, operating the site at sunny.day. By using this site you accept these terms. If you do not accept them, do not use the site.
2. What sunny.day is
sunny.day is a destination discovery and price comparison site. We are not a hotel, not an airline and not a tour operator, and today we do not sell travel. We display hotel and flight information obtained from third-party supplier data. Hotel rates currently come from LiteAPI and RouteStack. Flight data currently comes from Duffel and RouteStack.
Where we show hotel or flight information, it is for trip planning. If you buy a room or a ticket elsewhere, your accommodation contract is with the property and your contract of carriage is with the airline, not with us.
Sections 3, 4 and 5 apply only once bookings open on sunny.day. No booking can be made here today (see the notice above), so they govern nothing yet. They are published now so you can read them before they apply.
3. Prices
Prices are quoted in US dollars and are live: they come from supplier systems in real time and can change between the moment you see them and the moment you book. A displayed price is an invitation to book, not a binding offer, until the booking is confirmed.
Quoted totals include unavoidable taxes and charges except where a line is explicitly marked as payable at the property (resort fees, city taxes and similar are commonly collected on site). Manifest pricing errors — a total obviously wrong by an order of magnitude — may be corrected or the booking cancelled with a full refund. We will not use that clause to escape a merely unprofitable price.
4. Your obligations
You must give traveller names exactly as they appear on the travel document being used, accurate dates of birth, and a working email address and phone number. You are responsible for travel documents, visas and entry requirements. You confirm you are 18 or over and able to enter into a contract.
5. Changes and cancellations
Cancellation follows the property's own policy, which is displayed before you pay. Some rates are fully refundable; some are non-refundable; that is set by the property, not by us. sunny.day charges no service fee of its own for a change or cancellation — you pay the supplier's fee and any rate difference.
Where a supplier cancels or materially changes your booking, we refund everything we collected, including otherwise non-refundable components.
6. Weather scores are forecasts, not guarantees
This is the important one. Every weather score, tier, clear-day count and window on this site is derived from a probabilistic forecast model. It is information, not a promise. sunny.day gives no warranty whatsoever as to actual weather conditions at any destination, on any date.
If you book a trip scored 9.5 and it rains for the entire week, you have suffered exactly what a forecast being wrong means. There is no weather-related refund, credit or compensation, and no liability on our part arising from conditions differing from the forecast.
What we do undertake is that the published scoring model at /methodology is the model actually applied, applied identically to every destination, with no commercial adjustment.
7. Limitation of liability
We are liable for our own negligence and for our own failures in any service we provide. We are not liable for the acts or omissions of suppliers, for delays, cancellations, overbooking, denied boarding, property closures, industrial action, weather, or other events outside our reasonable control.
We are not liable for indirect or consequential loss, including lost enjoyment, lost earnings or the cost of substitute arrangements. Where our liability is capped, it is capped at the total amount you paid us for the affected booking.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
8. Availability of the service
We do not warrant that the site will be uninterrupted or error-free. Forecast data is refreshed on a schedule and can be stale or incomplete; when it is, we report that on our status page rather than concealing it.
9. Acceptable use
Do not scrape, mirror or systematically extract the site's data, attempt to interfere with its operation, or, once bookings open, make speculative or fraudulent bookings. We may refuse service or cancel bookings where we reasonably believe this clause has been breached.
10. Intellectual property
The scoring model description, page content and site design are ours. Destination photography is licensed from Pexels and remains the property of the photographers credited. Hotel names, descriptions, ratings and images are supplied by third-party hotel data providers and remain theirs.
11. Governing law
These terms and any dispute arising from them are governed by the laws of the State of New York, and you and we submit to the exclusive jurisdiction of the state and federal courts located in New York.
12. Changes to these terms
We may update these terms. Once bookings open, the version in force for your booking is the one published at the time you booked. Material changes are noted by the date at the top of this page.
